These Terms of Service ("Terms") govern your access to and use of Glim ("Glim", the "Service", "we", "us"). By creating an account or using the Service, you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is greater) to use the Service. By using the Service you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.
2. Accounts
You are responsible for all activity that occurs under your account, including maintaining the confidentiality of your password and OAuth credentials. You agree to notify us promptly of any unauthorized use of your account.
3. The Service
Glim is a web-based toolkit of AI image utilities including, without limitation, image upscaling, outpainting (canvas extension), style transfer, and outfit style filters. You purchase prepaid credits, membership-period credit allowances, or member-only refill packs, and spend credits per generation. The Service is provided "as is" and we do not guarantee any specific result, output quality, or uninterrupted availability.
4. User Content
You retain ownership of images and other content you upload to the Service ("Inputs") and of the outputs generated using those Inputs ("Outputs"). You grant us a limited, worldwide, royalty-free license to store, process, transmit, and display Inputs and Outputs solely for the purpose of providing and improving the Service.
You represent and warrant that (a) you have all rights necessary in your Inputs to grant us this license, and (b) your Inputs and use of the Service do not violate any law or third-party rights (including copyright, trademark, privacy, and publicity rights).
5. Acceptable Use
You agree not to, and not to permit any third party to:
- Upload or generate content that depicts minors in any sexual context, or content that violates applicable law in your jurisdiction;
- Upload images of identifiable individuals without their consent, including for the purpose of creating sexual, defamatory, or impersonation content;
- Infringe the intellectual property, privacy, publicity, or other rights of any third party;
- Use the Service to distribute malware, spam, or attempt to probe or exploit system vulnerabilities;
- Resell, sublicense, or commercially redistribute the Service or its outputs at a scale inconsistent with normal personal or business use;
- Attempt to circumvent, disable, or interfere with the Service's content moderation, rate limits, or security features.
The Service performs automated content-safety screening on both uploaded Inputs and generated Outputs. We may refuse, remove, or quarantine any content that our moderation flags, in our sole discretion.
6. Credits & Payments
Credits and membership-period allowances are prepaid. Payment is processed by our Merchant of Record, Creem (and, where applicable, by Telegram Payments or NOWPayments for the corresponding channels). We do not store your full payment instrument details.
Membership periods unlock member-only refill packs for the active period shown at checkout; the credits delivered by a purchase remain in your account balance. Credits are non-transferable between accounts. Credits do not expire but remain subject to these Terms and to our Refund Policy. Refund eligibility is described in our Refund Policy.
7. Intellectual Property
All rights, title, and interest in and to the Service (excluding your Inputs and Outputs) — including software, models, branding, and documentation — are and remain our exclusive property.
8. Disclaimers
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OPERATION. AI-GENERATED OUTPUTS ARE PROBABILISTIC AND MAY CONTAIN ARTIFACTS, INACCURACIES, OR UNEXPECTED CONTENT; YOU ARE RESPONSIBLE FOR REVIEWING ANY OUTPUT BEFORE USING IT.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL OUR AGGREGATE LIABILITY UNDER OR IN CONNECTION WITH THESE TERMS EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (US$100). IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
10. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your Inputs or Outputs, (b) your violation of these Terms, or (c) your violation of any applicable law or third-party right.
11. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for conduct we reasonably believe violates these Terms, our Acceptable Use policy, or applicable law, or that is harmful to other users or to us. Upon termination, your right to use the Service immediately ceases, though applicable provisions of these Terms (including Sections 7, 8, 9, 10, and 13) survive.
12. Changes
We may modify these Terms from time to time. Material changes will be reflected in the "Last updated" date above and, where appropriate, communicated via email or in-product notice. Continued use of the Service after such changes constitutes acceptance of the updated Terms.
13. Governing Law & Disputes
These Terms are governed by the laws of the Hong Kong Special Administrative Region of the People's Republic of China, without regard to its conflict-of-laws rules. You agree to submit to the exclusive jurisdiction of the courts of Hong Kong for the resolution of any disputes arising out of or relating to these Terms.
